Cosco is offering consumers a $25 check for consumers to purchase a new mattress on their own. The mattresses were sold with Cosco model \"M\" tubular metal cribs, manufactured from July 1994 through September 1997. The \"M\" is the third character in the model number. The model number and manufacturing date are stamped on a label on the bottom of the crib's end panel. Bunk beds currently made by the companies listed below now meet the spacing requirement of the voluntary standard. The companies are also placing permanent labels on their bunk beds to warn that children under the age of six be prohibited from the upper bunk. CPSC learned of the bed's design deficiencies while investigating the death an of eight-month-old Oakland boy who became trapped between the mattress and the headboard. The large amount of space between the mattress and the headboard allowed passage of his body, but his head became entrapped. According to CPSC, the mattress was standard twin bed size, but the inside measurements of the bunk bed frame were too large for the mattress. The style of bed involved in the fatality was manufactured exclusively for Aaron Furniture and Mattress Company by Pacific Cascade Distributing of Redding, CA. Both firms went out of business in 1990. The affected bunk beds are made of darkly stained pine with 4-inch by 4-inch corner posts consisting of two \"2 x 4's\" nailed together. This construction appears to be unique to this bunk bed. The beds have a built-in ladder on the head or footboard. The outside dimensions of the bed are 80 inches long, 60 inches high by 44 inches wide. The beds sold for $40 to $100 each. (Feb. 9) -- The U.S. Consumer Product Safety Commission today announced that it has provisionally accepted a consent agreement prohibiting Airflow Mattress, Inc., Brooklyn, New York, a corporation, and Ralph Levine, individually and as an officer of the corporation, from manufacturing or importing products which fail to meet the requirements of the Flammable Fabrics Act. Specifically the agreement requires Airflow Mattress to conduct all flammability tests specified by the Mattress Standard (FF-4-72); to label each mattress manufactured with a permanent, accessible and legible label containing the appropriate production unit identification; and, to maintain all records required by the Standard and the Commission's regulations. Additionally as part of the provisional consent agreement, Airflow Mattress is to notify all of its customers who have purchased or to whom have been delivered mattresses manufactured by them between June 22, 1973, and December 22, 1973, that they may return these non-complying mattresses to the manufacturer for complete refund or replacement, at the option of the manufacturer, plus an allowance for reasonable costs (the means of transportation to be determined by the manufacturer). The Mattress Standard went into effect on June 22, 1973. However, a six-month \"grace period\" was provided during which manufacturers could attach warning labels to non-complying mattresses to indicate that they did not meet the Standard in lieu of compliance with the sampling and testing requirements. Since December 22, 1973, all newly manufactured mattresses must be produced in accordance with the sampling and testing requirements of the Standard. This agreement is for settlement purposes only and does not constitute an admission by Airflow Mattress, Inc., that it has violated the law. A future violation of this consent agreement by the company could result in the assessment of substantial civil penalties.
