My husband and I purchases a Martha Stewart Living Cascade Valley Dining Set of 7 Pieces at home depot in Everett, Ma. It was purchased on May28, 2011. On August 15th about 3 in the afternoon
my son and I heard a loud bang in the yard area. We ran out to the deck and found that the glass insert on the table exploded. Glass was everywhere, I am lucky it was raining and no one was on the deck or it would have been catastrophic. Because the glass table exploded I could have glass in my pool.
I did some research and the manufacturer JRA Furniture, headquartered in Cerritos, Calif. declared bankruptcy in 2007 due to pending lawsuits. Why is this unsafe product still sold in 2011 if the company went out of business in 2007.
There are pages of complaints the same or worse than mine available by goggling Martha Stewart patio table shattering. What happened to Consumer protection? This is a safety issue and nothing is done to stop these stores from stocking these tables.
The implied warranty of merchantability is a merchant's basic promise that the goods sold will do what they are supposed to do and that there is nothing significantly wrong with them. In other words, it is an implied promise that the goods are fit to be sold.I will be expecting a complete refund from Home Depot.
